Welcome to CRUDDA. The terms “we,” “us,” and “our” refer to CRUDDA LLC (“CRUDDA”).
CRUDDA operates this store and website, including all related information, content, features, tools, products and services provided to you through the website (collectively, the “Services”). Our online store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein (collectively, the “Terms”), describe your rights and responsibilities when you access or use the Services.
Please read these Terms carefully. They include important information regarding your legal rights, purchases, warranties, limitations of liability and other conditions governing your use of CRUDDA.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not access or use the Services.
SECTION 1 — ACCESS AND ACCOUNT
By using the Services, you represent that you are at least the age of majority in your state, province or jurisdiction of residence, or that you have provided any consent required for your minor dependents to use the Services on devices you own, purchase or manage.
To use certain Services, including purchasing products, you may be asked to provide information such as your name, email address, billing information, payment information and shipping information.
You represent that all information you provide is accurate, current and complete and that you have the right to provide such information.
You are responsible for maintaining the security of your account credentials and for activity conducted through your account. You may not transfer, sell, assign or license your account to another person.
SECTION 2 — OUR PRODUCTS
We make reasonable efforts to accurately display and describe our jewelry, materials, stones, colors, dimensions and other product characteristics.
However, colors and appearance may vary depending on your device, display settings, lighting conditions and photography.
Because jewelry may include natural materials, gemstones, handmade elements or individually produced components, minor variations between pieces may occur and do not necessarily constitute a defect.
Product descriptions, availability and specifications may be changed without notice.
We reserve the right to discontinue products or limit quantities available to any person, geographic region or jurisdiction.
SECTION 3 — ORDERS
When you place an order with CRUDDA, you are making an offer to purchase the selected products or services.
CRUDDA reserves the right to accept, decline, cancel or limit an order when reasonably necessary, including in connection with product availability, pricing or listing errors, suspected fraud, payment issues or required order verification.
Your order is not considered accepted until payment has been successfully processed and the order has been accepted by CRUDDA.
Certain orders may require additional verification before fulfillment. If verification is required, we may contact you for additional information.
Please review your order carefully before submitting it.
If you need to request a change or cancellation, contact CRUDDA as soon as possible. If an order has not entered processing or production, we may be able to accommodate the request. Once processing or production has begun, an order may no longer be changed or cancelled.

SECTION 4 — PRICES, PAYMENTS AND BILLING
Prices, discounts, availability and promotions may change without notice.
The price charged for a product or service will be the price displayed at the time the order is placed, subject to correction of errors as permitted by law.
Unless otherwise stated, displayed prices may not include applicable taxes, shipping charges, customs duties, import fees or other charges imposed by third parties or government authorities.
You agree to provide current, complete and accurate billing, payment and account information for purchases made through CRUDDA.
You represent that you are authorized to use the payment method submitted with your purchase.
Financing or installment payment options may be available for eligible purchases. Availability and terms are determined by the applicable payment provider and will be displayed at checkout when available.
SECTION 5 — SHIPPING, DELIVERY AND PICKUP
In-stock orders are generally processed within 1–3 business days, with delivery generally taking approximately 3–5 business days after processing.
These timeframes are estimates and are not guaranteed.
Made-to-order and custom jewelry require additional production time.
CRUDDA is not responsible for delays caused by shipping carriers, customs processing, severe weather, incorrect customer information or other events outside our reasonable control.
International orders may be subject to customs duties, taxes, import fees or other charges imposed by the destination country. Unless otherwise stated, these charges are the responsibility of the customer.
NYC pickup is available by arrangement. Pickup information will be provided when an eligible order is ready.
Once an order ships, tracking information will generally be provided by email.

SECTION 6 — RETURNS, EXCHANGES AND FINAL SALE
Because of the nature of our products, CRUDDA purchases are final sale unless an item arrives damaged, defective or incorrect, except where otherwise required by applicable law.
We do not accept returns or exchanges for change of mind, sizing preference, or items that have been worn or used.
Custom, personalized, special-order and made-to-order jewelry is final sale and cannot be returned or exchanged for change of mind.
Approved returns are issued as CRUDDA store credit unless otherwise required by applicable law.

If an item arrives damaged, defective or incorrect, submit a Return / Repair Request before sending anything back to CRUDDA.

SECTION 7 — CUSTOM & MADE-TO-ORDER JEWELRY
Custom and made-to-order jewelry is created or produced specifically for the customer's order.
Pricing may vary based on factors including design, dimensions, weight, metal, stone selection, stone quantity, complexity and other specifications.
Production begins only after the applicable design approvals and payment requirements have been satisfied.
Once a custom design has been approved and production has begun, changes or cancellations cannot be guaranteed and the order is final sale, except where otherwise required by law or where an item arrives damaged, defective or incorrect.
Production timelines are estimates. Most custom pieces take approximately 2–3 weeks after final design approval, while more complex projects may require approximately 3–6 weeks.
Minor differences between digital designs, CAD renderings and finished jewelry may occur as part of manufacturing, finishing, stone setting and polishing.

SECTION 8 — JEWELRY CARE, REPAIRS AND WARRANTY
Jewelry requires appropriate care to maintain its appearance and condition.
Normal wear, accidental damage, improper care, loss, misuse or damage resulting from unauthorized third-party alterations or repairs are not considered manufacturing defects.
Qualifying manufacturing defects may be eligible for coverage under CRUDDA's warranty and will be evaluated on a case-by-case basis.
Repairs and resizing may be available for eligible pieces. Most repairs and resizing services are paid services, with pricing and availability depending on the jewelry and work required.

SECTION 9 — INTELLECTUAL PROPERTY
The Services, including CRUDDA's trademarks, trade names, logos, designs, photographs, videos, graphics, text, product imagery, website design and other content, are owned by CRUDDA, its affiliates or licensors and may be protected by applicable intellectual property laws.
The Services are provided for your personal, non-commercial use.
Unless expressly permitted by CRUDDA, you may not reproduce, distribute, modify, publish, display, transmit, sell, license, exploit or create derivative works from CRUDDA content.
CRUDDA's names, logos, designs and branding may not be used without prior written permission.
Shopify's trademarks and intellectual property remain the property of Shopify and its respective licensors.
SECTION 10 — OPTIONAL TOOLS
We may provide access to tools, services or functionality operated by third parties.
Such third-party tools may be provided “as is” and “as available.” CRUDDA does not control every aspect of third-party services and is not responsible for their independent operation, availability or terms.
Your use of third-party tools is subject to any applicable third-party terms and policies.
We may introduce additional features, tools or resources in the future, which will also form part of the Services and may be subject to these Terms.
SECTION 11 — THIRD-PARTY LINKS
The Services may contain links to websites, services or materials provided by third parties.
CRUDDA is not responsible for the content, accuracy, availability, security or practices of third-party websites or services.
If you access a third-party website or service, you do so subject to that provider's applicable terms and policies.
Questions or disputes concerning third-party products or services should generally be directed to the applicable third party.
SECTION 12 — RELATIONSHIP WITH SHOPIFY
CRUDDA is powered by Shopify, which enables us to provide the Services to you.
However, sales and purchases made through our store are transactions directly between you and CRUDDA.
By using the Services, you acknowledge that Shopify is not responsible for the products purchased from CRUDDA or for the sales transaction between you and CRUDDA, except to the extent otherwise required by applicable law.
SECTION 13 — PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because our online store is powered by Shopify, certain personal information may also be collected and processed by Shopify and other service providers used to operate the Services.

SECTION 14 — FEEDBACK AND USER CONTENT
If you voluntarily submit reviews, photographs, comments, suggestions, ideas or other content to CRUDDA, you represent that you have the necessary rights to provide that content.
Unless otherwise agreed in writing or prohibited by applicable law, you grant CRUDDA a non-exclusive, worldwide, royalty-free license to use, reproduce, display and distribute content you intentionally submit for purposes related to operating, improving and promoting CRUDDA and the Services.
You may not submit unlawful, defamatory, infringing, misleading, abusive, obscene or malicious content.
You remain responsible for the content you submit.
SECTION 15 — ERRORS, INACCURACIES AND OMISSIONS
Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, availability or other information.
We reserve the right to correct errors, update information or cancel affected orders when reasonably necessary, including after an order has been submitted, subject to applicable law.
SECTION 16 — PROHIBITED USES
You may use the Services only for lawful purposes.
You may not use the Services to:
- Violate applicable laws or regulations.
- Infringe the intellectual property or other rights of CRUDDA or another party.
- Submit false, fraudulent or misleading information.
- Harass, threaten, abuse or harm another person.
- Transmit malicious software, viruses or harmful code.
- Engage in fraud, phishing, spam or other deceptive activity.
- Attempt to gain unauthorized access to our systems or accounts.
- Interfere with or circumvent website security or access controls.
- Scrape, reproduce, extract or commercially exploit CRUDDA content without authorization.
We reserve the right to restrict or terminate access to the Services when we reasonably determine these Terms have been violated.
SECTION 17 — TERMINATION
We may suspend or terminate access to all or part of the Services when permitted by applicable law, including where these Terms have been violated.
Termination does not eliminate payment obligations or other obligations that arose before termination.
Provisions that by their nature should survive termination will remain effective.
SECTION 18 — DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the Services are provided “as is” and “as available.”
Except for warranties expressly provided by CRUDDA or rights that cannot legally be excluded, we do not guarantee that the Services will always be uninterrupted, secure, error-free or available.
Nothing in these Terms excludes or limits warranties, guarantees or consumer rights that cannot legally be excluded or limited.
SECTION 19 — LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, CRUDDA and its affiliates, officers, employees, contractors, service providers and licensors will not be liable for indirect, incidental, special, punitive or consequential damages arising from your use of the Services or products purchased through the Services.
Nothing in these Terms limits liability that cannot legally be excluded or limited under applicable law.
SECTION 20 — INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless CRUDDA, Shopify and their respective affiliates, officers, directors, employees, agents, contractors, licensors and service providers from third-party claims, losses or liabilities arising from your material violation of these Terms, applicable law or the rights of another party.
SECTION 21 — SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed as necessary.
The remaining provisions will remain in effect.
SECTION 22 — WAIVER & ENTIRE AGREEMENT
Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.
These Terms and the policies incorporated by reference constitute the agreement between you and CRUDDA regarding your use of the Services and supersede prior agreements concerning the same subject matter.
SECTION 23 — ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms without our prior written consent.
CRUDDA may assign or transfer its rights and obligations as permitted by applicable law.
SECTION 24 — GOVERNING LAW
These Terms and any separate agreements through which CRUDDA provides Services will be governed by applicable law in the jurisdiction where CRUDDA LLC is headquartered, without limiting any mandatory consumer protections that may apply to you based on your location.

We reserve the right to update or replace portions of these Terms by posting an updated version to our website.
Where required by applicable law, we will provide notice of material changes.
Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms to the extent permitted by law.
